På trods af at have gået sin sejrsgang over det meste af verden, er der ingen tvivl om at piratkopierne har været et enormt problem for Nintendo DS, og altså også et af de steder vi kan forvente at se en kraftig forbedring når Nintendo 3DS lanceres.
Ian Curran, global publishing VP hos THQ, har således snakket med giganten om problemet og er blevet lovet at sikringen skulle være markant bedre denne gang. Således siger han i et interview med CVG:
"What excites me even more [than 3DS games] is that there's technology built in that device to really combat piracy... I actually asked Nintendo to explain the technology and they said it's very difficult to do so because it's so sophisticated.They combated the piracy on DSi, which they don't believe is cracked yet -- but they know they've been hurt across the world and they believe the 3DS has got technology that can stop that."
