Da staten California først fremlagde deres sag imod Activision Blizzard, og efter Frances Townsends originale svar, så lagde virksomhedens ledelse sig relativt fladt ned, og proklamerede at de ville lade sagen gå sin gang.
Det lader dog til, at de bag scenetæppet har gjort alt andet det, for de beskyldes nu blandt andet at pille ved potentielt bevismateriale, og direkte destruere vigtige dokumenter. Som Axios skriver har statens Department of Fair Employment and Housing, eller DFEH, opdateret deres søgsmål, hvor de klager over at Activision Blizzard angiveligt skulle have makuleret papirer, og generelt "blandet sig" i efterforskningen.
Activision Blizzard skal, ved lov, "maintain and preserve any and all relevant records and files until such complaint is fully and finally disposed of and all appeals from related proceedings have concluded", men det siger DFEH at de virkelig ikke har gjort.
"DFEH is [...] informed and aware that documents and records have not been maintained as required by law, or by the DFEH's Document Retention Notice, including but not limited to documents related to investigations and complaints were shredded by human resources personnel and emails are deleted 30 days after an employee's separation."
Ikke bare det, Activision Blizzard skulle angiveligt også have direkte blandet sig i efterforskningen, og bevidst gjort det sværere for DFEH at udføre deres arbejde.
"Defendants refused to produce relevant evidence to DFEH, claiming that the company's 'receipt [of complaints] or investigation of discrimination or harassment complaints is privileged', and they thereby suppressed evidence and interfered with a government investigation seeking relief for employees who suffered unlawful conduct."
Activision Blizzard har ikke svaret igen på anklagen.
